Pixel Jammer – Terms and Conditions

General
These terms and conditions apply to all contracts for the supply of photography, videography, drone filming, audio recording, editing, and related services (“Services”) by Pixel Jammer, a trading name of [Martin Tompkins Photography], whose registered office/studio is in Melksham, Wiltshire, United Kingdom (“we”, “us”, “Pixel Jammer”).
Booking & Deposit
- A booking is only confirmed once we have received a signed Booking Form (or written confirmation by email) and a non-refundable deposit of 50% of the total fee (unless otherwise agreed).
- The remaining balance is due 7 days before the shoot date, or on the shoot day for bookings under £1,000.
Cancellations & Postponements
- Client cancellation: Deposit is forfeited. If cancelled within 7 days of the shoot, 100% of the total fee is payable.
- Postponement due to weather (drone or outdoor shoots): We will offer up to two free reschedule dates within 3 months. Further postponements incur a £150 re-booking fee.
- We reserve the right to cancel or postpone due to illness, equipment failure, or force majeure with no liability beyond refunding any payments already made.
Creative & Artistic Direction
You accept that Pixel Jammer has full artistic licence in relation to shot composition, editing style, colour grading, and final delivery format.
Licence & Usage Rights
- You are granted a non-exclusive, perpetual licence to use the final deliverables for the purposes agreed in the quote/booking form (e.g., website, social media, marketing, streaming, physical products).
- Pixel Jammer retains the copyright and moral rights in all material. We may use the work in our portfolio, website, showreel, and marketing unless you purchase an exclusive licence (additional fee applies).
Delivery & Revisions
- First draft delivered within 21 working days (or as agreed).
- Two rounds of reasonable revisions are included. Additional revisions are charged at £40 per hour.
Client Responsibilities
- Provide access, permissions, and any necessary licences (e.g., venue, music sync licences).
- Ensure products/props are clean, complete, and ready at the agreed time.
- Obtain all necessary model/property releases where required.
Drone Operations
All drone flights are conducted under our CAA Operational Authorisation and full public liability insurance. Client must ensure the location is legal and safe for drone use.
Payment Terms
- Payments by bank transfer within 14 days of invoice (7 days before shoot for balance).
- Late payment incurs statutory interest under the Late Payment of Commercial Debts Act 1998.
Liability
Our total liability is limited to the total fee paid for the Services. We are not liable for indirect or consequential loss.
Data Protection
We comply with UK GDPR. Personal data is only used to fulfil your booking and (with consent) for marketing. See our Privacy Policy at pixeljammer.co.uk/privacy.
Governing Law
These terms are governed by the laws of England and Wales.
Changes to Terms
We may update these terms from time to time. The version on our website at the time of booking applies.
